Article 21 of the EU’s Digital Services Act (DSA) allows national Digital Services Coordinators (DSCs) to endow organisations with the task of settling content moderation disputes. These organisations, out-of-court dispute settlement (ODS) bodies, can then issue decisions on whether content moderation actions, such as the removal of posts or the demotion of content, were justified or not. These decisions will be non-binding, but platforms have an obligation to cooperate with ODS bodies in good faith. The creation of independent bodies with a legal mandate to review all sorts of content moderation actions is, worldwide, unprecedented. Out-of-court dispute settlement has the potential to improve platform accountability and protect rights and democracy. How out-of-court dispute settlement should work and how it can realise this potential is still largely unclear. As one of the first organisations to seek certification, User Rights is a pioneer in the field. Its mission is to provide effective redress for users while helping to protect democracy and the rights of others. It will work with academics, civil society and regulators to lead by example and through its work set best practices that will allow for out-of-court dispute settlement to become a meaningful mechanism of content moderation accountability.
